Cuomo – Scandal-plagued New York Gov. Andrew Cuomo has been hit by a new bombshell report that his top aides altered the data on the number of nursing home residents who died in the pandemic.

The latest developments were reported late Thursday by The New York Times and The Wall Street Journal.

According to the report, Cuomo’s top aides, concerned about state health officials’ numbers,  fudged the data.

The number, more than 9,000 by June, the Times says, was not yet public. The aides rewrote the report to take the figure out, the Times said, citing interviews and documents.

The report in July focused only on residents who died in long-term care facilities, leaving out those who died in hospitals after becoming sick in nursing homes, the Journal said.

The report said 6,432 nursing-home residents died from the outbreak, which was a significant undercount of the death toll attributed to the state’s most vulnerable population, the Journal added, citing sources with knowledge of the report’s production.

“The out-of-facility data was omitted after DOH (Department of Health) could not confirm it had been adequately verified,” Beth Garvey, a special counsel and senior adviser to Cuomo, told the Journal and the Times late Thursday, claiming the additional data did not change the report’s conclusion.

After the state attorney general revealed recently that thousands of nursing home resident deaths had been undercounted, Cuomo finally released the complete count, saying he had withheld it out of concern that the Trump administration might use it for political purposes against the state.

The Times report suggests that Cuomo and his aides began concealing the data much earlier.

This unfolded even as Cuomo, now also at the center of an expanding scandal involving allegations of sexual harassment, was starting work on a book touting his achievements in the pandemic.

Cuomo – New York Governor Andrew Cuomo signed a bill two years ago that substantially lowered the bar for proving sexual harassment claims, making it easier now for his accusers to meet the required standards, The Washington Free Beacon reported on Wednesday.

The bill Cuomo signed into law states that harassment does not need to be “severe or pervasive” to be unlawful, specifying that any action that rises above “petty slights and trivial inconveniences” can qualify.

The governor’s alleged misconduct appears to exceed this standard.

A New York employment lawyer explained to the Free Beacon, for example, that if a male supervisor makes a female worker uncomfortable by asking her out to lunch, “that could be the basis for a claim.”

The bill Cuomo signed also got rid of the main defense that could have been used in court. Under federal law, an employer can avoid liability if their worker never filed a formal complaint concerning the harassment, which neither of Cuomo’s accusers did.

But under the law Cuomo signed, the absence of formal complaints “shall not be determinative” of liability, meaning a worker can win even if she did not make use of an internal grievance procedure.

At the time he signed the law, Cuomo said that “The ongoing culture of sexual harassment in the workplace is unacceptable and has held employees back for far too long. This critical measure finally ends the absurd legal standard for victims to prove sexual harassment in the workplace and makes it easier for those who have been subjected to this disgusting behaviour to bring claims forward.

Cuomo – New York Governor Andrew Cuomo’s office cleared the way on Sunday for an independent attorney with subpoena powers to investigate allegations against him of sexual misconduct.

The governor’s office backtracked on its original plan to choose its own investigator after widespread criticism from fellow Democrats.

“We will hire a law firm, deputize them as attorneys of our office, and oversee a rigorous and independent investigation,” New York Attorney General Letitia James said in a statement.

Cuomo, one of the nation’s most well-known Democratic politicians whose popularity soared during the early months of the pandemic, has been accused by two former aides of sexual misconduct, sparking criticism from fellow Democrats that ranged from calls for his resignation to appeals for an independent investigation into his behavior.

Responding to the latest allegations that emerged on Saturday, the governor denied making any sexual advances and initially ordered what he said would be a “full and thorough outside review” led by a former federal judge, Barbara Jones.

But following sharp rebukes from Democrats, Cuomo reversed that decision – and issued a statement late on Sunday saying he “never intended to offend anyone or cause harm.”

Cuomo said he is often jocular around the office and in public, citing his frequent press conferences that included plenty of banter with members of the media.

“I now understand that my interactions may have been insensitive or too personal and that some of my comments, given my position, made others feel in ways I never intended,” Cuomo said in a statement.

Cuomo on Saturday ordered what he said would be a “full and thorough outside review” led by Jones. But that move was quickly rejected by leading Democratic figures including U.S. Representative Alexandria Ocasio-Cortez of New York, who said she found the accounts of Cuomo’s former aides Lindsey Boylan and Charlotte Bennett “extremely serious and painful to read.”

There were also demands for an independent probe from several other Democrats. White House Press Secretary Jen Psaki told CNN’s State of the Union that President Joe Biden supported such an investigation. Others, including New York State Senator Alessandra Biaggi and New York City Councilman Carlos Menchaca, went further, echoing Republican calls for Cuomo to resign.
